Starting from November 1, 2024, the requirement for condominium approval to register an LA has been officially revoked. This change gives more freedom to those who wish to operate an LA in buildings under horizontal ownership.
Until now, if a property owner wanted to register an LA in a building with a condominium, they needed to obtain approval from the majority of co-owners in a meeting and record this decision in the minutes. With the revocation of this requirement, this step is no longer necessary, making the registration process faster and less bureaucratic.
Despite the removal of the ATA requirement, co-owners still have the right to oppose LA activity in certain situations, such as when there is proven impact on the building’s security or tranquillity.
If you own a property in a horizontal ownership building and want to start an LA business, the process is now simpler. You only need to meet the standard registration requirements at the Balcão do Empreendedor, without requiring formal approval from other co-owners.
