If you are considering turning your property into a Local Accommodation (AL) in Madeira, it is essential to ensure that you have all the necessary documentation for registration. The process is simple but requires some important steps to ensure everything is legally compliant.
The registration of a Local Accommodation is done through a prior communication with a deadline on the Balcão do Empreendedor. Here is the required documentation:
✅ Identification of the operator:
If an individual: copy of the Citizen Card or Passport.
If a company: access code to the permanent business registration certificate.
✅ Statement of responsibility:
Signed declaration by the operator, confirming that the property meets all legal requirements and is suitable for accommodation.
✅ Proof of legitimacy over the property:
Property tax document (if the owner).
Lease contract with explicit authorization for Local Accommodation (if a tenant).
✅ Declaration of business activity registration:
Proof of business registration for AL operation.
✅ Title of property use number:
Required for buildings whose construction license was issued after 1951.
✅ Liability insurance:
Mandatory insurance policy to cover potential damages to third parties.
After submitting the application, the City Council has 60 days to review and, if necessary, oppose the registration. If there is no opposition, your Local Accommodation will receive a registration number and can start operating!
⚠️ Attention: Operating an AL without registration may result in significant fines – up to €4,000 for individuals and €40,000 for companies.
